The title throws me off, that's not the tallest building anymore, the tallest is the SoL.

It is a building, people can go in it therefor making it a building. A statue is something different, it is this:
The only reason it's called the STATUE of liberty is because:
The Eiffel tower is a building, not Statue Eiffel Tower.
